I do agree that Smart Corner does not see "instant equity" or they would take the condo back and make the extra profit themselves. They also don't want to seem too lenient by letting one buyers off the hook as it can lead to a domino effect of cancellations, a la Miami style (news spreads fast).
If this buyer is really experiencing the hardship he says he is, he has a good change of getting his money back. The $7,500 is not a lot and he can go to small claims court to sue for his money back. Considering his situation, the judge might give it back to him.
Also consider that he can make life difficult for Smart Corner by contacting the press and campaigning against "heartless, blood sucking" developers. He's unemployed so if he can spend his time getting his $7,500 back then all the better. A penny saved is a penny earned.

| I'm not sure if any units are finished or anyone has closed yet - I'd be surprised if either of things had happened yet. I think SmartCorner was saying June or July but that means Aug or Sep to me. |

I have seen my finished unit and it was better than I had expected(I also viewed a model with furniture on the 9th floor....funny the unit looked larger with furniture)......I bought a small studio facing Balboa......and like many of you on this forum......I do feel like it is a lot of money for such a small unit. But after checking out all of the common areas.....especially the rooftop....I was definitely sold.......the same quality(attention to detail) you see on the outside.......is what you get on the inside. Balconies on the studios are pretty roomy as well.
I can tell you at least half of the units have been finished......I am currently scheduled to close by the end of this month......assuming they can get they're freakin C of O.
As far as HOA goes.......Cable/internet/phone is provided by Digital Streets(the packages look good so far)...internet speed is 512k.....each unit will have it's own bandwith. Contrary to what the guy selling his condo said.....you do have to pay electric & maybe gas. |

Will this be your primary home or is it more of a second home/investment?
I do like this building as well, it came together nicely in my view. The rooftop is spectacular and the floorplans are well laid out. The neighborhood is spotty but will get better with increase development. |

| Only 512k for Internet?! That's slow. The should have some kind of fiber link. Well at least you don't have to get land line phone service for DSL or Cable. |

April......I'm sorry but that's pretty funny! Considering there is 4 levels of below grade parking at the site that is free to prospective buyers. I think it's funny that people find the location dangerous.......I live on Cortez Hill currently and have walked over to the site periodically since last october......never been harrased by anyone whatsoever.....even at night....for crying out loud. By the way folks......this building has a state of the art security system.....you can only enter the elevators with credentials. I believe someone will be stationed in the lobby.
Yes, this will be my primary home.....as I will be able to walk 4 blocks to work:) |

Unfortunately the HOA's have recently went up $55 to freakin $455/mo. for STUDIOS!! I'm gonna do my best to get on the HOA committee and see what the deal is.

| HOA is a topic of interest to me as well. An HOA is a mini-government. I wonder how the HOAs will handle maintenance of communities past 30 years from their creation. It seems like every new housing unit is now part of an HOA. It'll be interesting, 30 years from now to look at all those communities and see how they're doing.

| If you have First American for your escrow there is a decent chance you have CD with all your documents on it including a PDF file with the HOA budget. I'd be interested in reading it as well. |

I am also a buyer at Smart Corner, but I was told that I can't see my unit until ~2 weeks before closing. They used to let me see my unit when they were having hard hat tours, but recently they said no one is allowed to see their unit.
How did you see your unit SCBuyer?
I think they won't let you see you own unit, but they might let you look at a unit owned by someone else. Anyway it seems weird to me. Why would they do this?
As for the Cable/internet/phone deal, the HOA provides for basic service in all 3 areas but you can pay extra monthly charges to upgrade the services (i.e. if you want faster internet you can extra for it)

| They probably don't want buyers going into their own unfinished unit and coming up with "punch list" items. That would be annoying for the builder if they are already planning on fixing the items before the official walkthrough, and extra annoying if they were planning on hiding them! |

Did anybody see that they are going to locate a senior citizen soup kitchen and social services office in the new San Diego Housing Commission building right across from the Smart Corner residential tower. | I think that Smart Corner is the whole complex with a residential building and an office building. So it appears the soup kitchen will be right within Smart Corner. Great if live at Smart Corner and want to do volunteer work. Perhaps you will want to give shelter in your new digs to some of the homeless people who arrive by trolley.
