I understand the undesirable aspects of a soup kitchen -- what I don't understand is how the retail spaces' use as such is legally any different than anything else such as say a 7-11 or a Starbucks. In fact there are plenty of retail uses that draw low income and/or homeless clientele such as pawn shops, dollar stores or check cashing places. How is a soup kitchen any different from a legal standpoint?
Is the developer obligated to make potential buyers aware of any nearby retail use once it's known? I've never heard of such a law.
Given Smart Corner's location deep in East Village (and RIGHT ON public transit no less) it's not unreasonable to expect retail uses that cater to undesirable customers in surrounding buildings. It's location is one the aspects turning people off from buying there. |

Retail: The sale of goods to ultimate consumers. To sell at retail directly to the customer.
Soup kitchen is not retail. It's free soup. It's a public service or governmental office. Much different than 7-11 or pawn shop or check cashing....which by the way might be a good thing to open now at Soup Corner.
Birds of feather flock together, and when you throw some free bread crumbs in the air, watch out for the pigeons.

What difference does it make whether it's for profit or not for profit? Does the law say that when space is leased to a non-profit, anyone selling condos in the area must disclose such to potential buyers? I find that highly unlikely.
What's more likely to be happening is that the market is underwater and now some people are trying like hell to find any excuse to nullify their contracts and get their deposits back. |

And by the way, "soup kitchen" is a misnomer apparently applied by the original commenter. It's really a senior center on the second floor. From the original post in another message thread:
"Senior Community Centers to locate a social service and congregate meal facility in East Village on the second floor of the newly-constructed Smart Corner office building at 1122 Broadway. The facility will provide breakfast and lunch meals, nutrition and health education, healthcare and social services, entitlement and legal counseling and case management."

| You are naive to think that a place called a senior center which provides free meals, social services, free legal counseling and healthcare is any different than food service to the homeless, like a soup kitchen. They will be coming for the food, and they will take the healthcare and legal services as band-aids when they choose. This is not your grandpa or grandma coming to Smart Corner. |

You are going to see a lot more people trying to fight their way out of contracts and commitments they made a few years ago to new housing. If the DRE lets people out of these contracts this is a BAD thing for the marketplace as the risk of brining a condo project to market will be even more risky. As we saw during the bubble the new condo flippers feasted on these deals and didn't complain about a civil service facility or other non structural issues with the unit.

| You should only be let out of the contract if there are material changes in the contract.
Otherwise, you are getting a free option if you can back out of the contract with no reprocussions. |

Yes it seems their were material changes 500pgs I checked this out with a big time bank person and he said they can't make changes and expect you to sign a new contract. I really like the building and all the windows but the change thing is very scarey it sounds like an Enron kind of thing lots of paper to hide the real important stuff.
